Terms & Conditions

Terms and Conditions governing all bookings made directly, through agents, or through online platforms.

1. DEFINITIONS AND INTERPRETATION

1.1 Definitions

In these Terms and Conditions, unless the context indicates otherwise:

1.1.1. “Booking” means a reservation for any tour, safari, or travel service arranged by Envision Africa Travel and confirmed in writing.

1.1.2. “Booking Confirmation” means written confirmation issued by Envision Africa Travel or its authorised agent.

1.1.3. “Client” means any person or entity making a Booking and all persons included therein.

1.1.4. “Envision Africa Travel”, “we”, “us”, or “our” means Envision Africa Travel, acting as tour operator and/or booking intermediary.

1.1.5. “Force Majeure Event” means any event or circumstance beyond the reasonable control of Envision Africa Travel or a relevant Supplier, whether foreseeable or not, which prevents, delays, or materially interferes with the performance of any obligation under these Terms.

1.1.6. “Guest” or “Traveller” means any person participating in a Booking, whether or not they are the Client.

1.1.7. “Main Booker” means the person who concludes the Booking, whether on their own behalf or on behalf of other Guests.

1.1.8. “Supplier” means any third party providing accommodation, transport, vehicle rental, flights, activities, or other services forming part of a Booking.

1.1.9. “Travel Services” means all tours, safaris, and related services arranged or facilitated by Envision Africa Travel.

1.2 Interpretation

1.2.1. Clause headings are for convenience only and do not affect interpretation.

1.2.2. Words importing the singular include the plural and vice versa; words importing any gender include the other genders.

1.2.3. “Including” means “including without limitation.”

1.2.4. Where a time period is specified, it is calculated by excluding the first day and including the last day, unless the last day falls on a public holiday, in which case it extends to the next business day.

2. APPLICATION OF THESE TERMS

2.1. These Terms and Conditions apply to all Bookings, quotations, and travel agreements entered into with Envision Africa Travel, whether made directly by a Client, through an agent, or through an online platform.

2.2. These Terms, together with the applicable Booking Confirmation and any Supplier terms incorporated by reference, constitute the entire agreement between the Client and Envision Africa Travel.

2.3. Where a Booking is made by an agent, employer, or group organiser on behalf of others, that person warrants that they act with the full knowledge and consent of all Guests and accepts responsibility for compliance with these Terms on their behalf.

3. BOOKINGS AND FORMATION OF CONTRACT

3.1. No binding contract arises between the Client and Envision Africa Travel until the Booking has been accepted and a written Booking Confirmation has been issued.

3.2. All quotations, itineraries, and provisional reservations are non-binding, indicative only, and subject to availability at the time of confirmation.

3.3. The Main Booker must provide complete and accurate information about all Guests at the time of booking, including full names as they appear on travel documents, contact details, and any special requests, dietary requirements, or medical considerations.

3.4. Envision Africa Travel is entitled to rely on all information provided and shall not be liable for any consequences arising from incorrect, incomplete, or misleading information supplied by the Client.

3.5. The Main Booker warrants that they have full legal capacity and authority to bind all Guests included in the Booking, and indemnifies Envision Africa Travel against any loss or claim arising from a lack of such authority.

3.6. The Client may, before the trip commences, request to replace a participating Guest with another person, subject to: the replacement accepting these Terms; the request being submitted at least seven working days before departure; and no Supplier rejecting the replacement. The Main Booker, the Guest being replaced, and the replacement Guest remain jointly liable for the full amount payable, including any adjustment costs.

4. PAYMENTS AND PRICING

4.1. All prices quoted are inclusive of VAT unless expressly stated otherwise, and exclude any additional levies, park fees, taxes, or bank charges unless stated in writing.

4.2. A non-refundable deposit of 25% of the total quoted price is required to confirm a Booking, unless otherwise agreed in writing.

4.3. The balance of payment is due no later than 60 days before the date of departure. If full payment is not received by the due date, Envision Africa Travel will give the Client written notice of a final opportunity to pay within seven working days; if payment is still not received, the Booking is deemed cancelled by the Client and the deposit is forfeited as a cancellation charge.

4.4. If a Booking is accepted within 45 days of departure, full payment is due immediately on acceptance.

4.5. Envision Africa Travel reserves the right to correct any bona fide clerical, computational, or pricing error at any time prior to the issuance of a Booking Confirmation, and, where reasonably necessary, thereafter.

4.6. The Client bears all bank charges, card fees, international transfer costs, and exchange-related charges. Any shortfall arising from exchange rate movements must be settled prior to the commencement of travel.

Anti-fraud notice: Envision Africa Travel will never ask you to make a payment into a bank account outside of Namibia. If you receive a request to do so purporting to be from us, please contact us directly to verify it before paying.

5. CANCELLATIONS AND AMENDMENTS

5.1. All requests for cancellation or amendment must be submitted in writing and are effective only upon written acknowledgement of receipt by Envision Africa Travel. Requests made outside office hours are deemed received on the next working day.

5.2. If a Booking is cancelled by the Client, in addition to any direct, non-recoverable costs already incurred (such as prepayments to lodges, hotels, or activity providers), the following cancellation fees apply, calculated on the total amount payable:

5.3. Cancellation of the Booking by one Guest in a group booking is treated as a cancellation of that Guest's portion only, provided the remaining Guests wish to continue and the reduced group size remains viable under the applicable itinerary; the cancellation fee in clause 5.2 applies to the cancelled portion.

5.4. No refunds are payable for unused services, early departure, or voluntary curtailment once travel has commenced.

5.5. Where a Supplier imposes a higher cancellation fee or a more stringent deposit requirement than set out above, the Supplier's charge applies and the Client remains liable for it.

5.6. Envision Africa Travel reserves the right to cancel a Booking due to significant and unforeseen circumstances, without being obliged to specify a reason, by written notice within a reasonable time. In that event, the Client will be refunded all amounts already paid to Envision Africa Travel, but Envision Africa Travel is not responsible for related costs incurred outside the Booking, such as independently booked flights.

6. ROLE OF SUPPLIERS AND LIMITATION OF RESPONSIBILITY

6.1. Travel Services are provided, in whole or in part, by third-party Suppliers, including accommodation providers, vehicle rental companies, airlines, and activity operators.

6.2. Unless expressly stated otherwise in writing, Envision Africa Travel acts solely as an intermediary and booking agent, facilitating arrangements between the Client and the relevant Supplier(s). The contract for the supply of a Supplier's product or service is concluded directly between the Client and that Supplier.

6.3. Each Supplier provides its services subject to its own terms and conditions, which are incorporated by reference into the Booking. Where there is a deviation between these Terms and a Supplier's terms, the Supplier's terms apply to that Supplier's product or service.

6.4. Envision Africa Travel does not warrant, guarantee, or assume responsibility for the performance, quality, safety, or suitability of any Supplier-provided product or service, and is not liable for the acts or omissions of any Supplier, including failure to provide a service as booked, or the insolvency or cessation of operations of a Supplier.

6.5. Envision Africa Tours reserves the right to substitute a Supplier, vehicle, or accommodation with a reasonably comparable alternative where reasonably necessary due to availability or circumstances beyond its control. Such substitution does not give rise to a right of cancellation or refund, provided the substitute is reasonably comparable in standard.

6.6. Nothing in this clause excludes or limits Envision Africa Travel's liability to the extent such exclusion is prohibited by applicable law.

7. HEALTH, SAFETY, AND ASSUMPTION OF RISK

7.1. The Client and each Guest acknowledge that tours frequently operate in remote, rural, or wilderness environments with limited infrastructure and access to emergency services, and that such environments involve inherent risks, including wildlife encounters, uneven terrain, extreme weather, and limited or delayed access to medical care or evacuation.

7.2. By making a Booking, the Client accepts these inherent risks on behalf of themselves and all Guests, and confirms that all Guests are in a physical and medical condition suitable for the booked activities and accept personal responsibility for their own conduct and decisions.

7.3. The Client and Guests must comply with all safety instructions given by Envision Africa Travel, its guides, or suppliers. Failure to do so may result in exclusion from an activity, termination of participation, and forfeiture of fees paid, without refund.

7.4. The Client must be in possession of valid travel documents, including a valid passport, visa where applicable, and driver's licence where relevant. Any additional requirements for children travelling internationally (full birth certificates, consent letters, or affidavits from non-travelling parents or guardians) are the Client's responsibility.

7.5. To the maximum extent permitted by law, Envision Africa Travel shall not be liable, and the Client indemnifies and holds Envision Africa Travel harmless, from and against any loss, damage, injury, illness, or death arising from or connected to the inherent risks of wilderness travel or outdoor activities, or from the acts or omissions of any Supplier. This clause does not exclude or limit liability for Envision Africa Travel's own gross negligence or wilful misconduct, or to the extent such exclusion is prohibited by applicable law.

8. INSURANCE

8.1. Clients are strongly advised to obtain comprehensive travel insurance prior to departure, covering at minimum: cancellation and curtailment; medical treatment and emergency evacuation; personal accident and liability; and loss of or damage to personal belongings.

8.2. Envision Africa Travel does not provide travel, medical, or personal accident insurance to Clients or Guests unless expressly stated in writing, and does not act as an insurer, broker, or insurance intermediary.

8.3. Failure to obtain appropriate insurance is at the Client's own risk, and Envision Africa Travel is not liable for any loss that would reasonably have been covered by appropriate travel insurance, whether such insurance was obtained or not.

9. LIMITATION OF LIABILITY

9.1. To the maximum extent permitted by applicable law, Envision Africa Travel shall not be liable for any indirect, consequential, incidental, or economic loss, including loss of profits, loss of enjoyment, or loss arising from delay, cancellation, or missed connections.

9.2. Where Envision Africa Travel is found to be legally liable for any loss, damage, or claim arising from or in connection with a Booking, such liability is, to the maximum extent permitted by law, limited in aggregate to the amount actually paid by the Client to Envision Africa Travel for the Booking giving rise to the claim.

9.3. Nothing in these Terms excludes or limits Envision Africa Travel's liability for gross negligence or wilful misconduct, or to the extent that such exclusion or limitation is prohibited by applicable law. Where the law requires Envision Africa Travel to accept liability notwithstanding these Terms, such liability is limited to the minimum extent required by law.

9.4. The Client acknowledges that the limitations and exclusions in this clause reflect a fair and reasonable allocation of risk between the parties, having regard to the nature of the Travel Services offered, the price paid, and the availability of insurance.

10. DATA PROTECTION AND INFORMATION SHARING

10.1. Envision Africa Travel collects and processes personal information of Clients and Guests, limited to what is necessary for booking administration, coordination with Suppliers, compliance with legal and regulatory obligations, and customer support.

10.2. Personal information is processed on the basis of performance of the Booking contract, compliance with legal obligations, Envision Africa Travel' legitimate business interests, or the Client's consent where required.

10.3. Envision Africa Travel will keep Client and Guest data safe and confidential and will not share it freely with third parties without consent, except where sharing with a Supplier is strictly necessary to perform the Booking, or where required by law.

10.4. Where personal information is shared with a Supplier or third party outside Namibia, Envision Africa Travel will take reasonable steps to ensure such transfer is subject to appropriate safeguards.

10.5. Clients and Guests may, subject to applicable law, request access to, correction of, or deletion of their personal information by contacting Envision Africa Travel directly.

10.6. By making a Booking, the Client consents, on their own behalf and on behalf of all Guests included in the Booking, to the processing of personal information as described in this clause.

11. FORCE MAJEURE

11.1. Force Majeure Events include, without limitation, acts of God, natural disasters, extreme weather, pandemics or public health emergencies, war, terrorism, civil unrest, strikes, governmental acts, border closures, travel restrictions, closure of national parks or airspace, and any act or omission of a Supplier arising from such an event.

11.2. Envision Africa Travel is not liable for any failure, delay, or partial performance resulting from a Force Majeure Event, and affected obligations are suspended for the duration of the event to the extent reasonably necessary.

11.3. In the event of a Force Majeure Event, Envision Africa Travel may, acting reasonably and in good faith, amend itineraries, substitute Suppliers or services with reasonably comparable alternatives, or cancel the affected Booking in whole or in part.

11.4. Where cancellation becomes necessary due to a Force Majeure Event, any refund is subject to amounts actually recovered from Suppliers, less any non-recoverable costs already incurred.

11.5. Nothing in this clause excludes or limits any right or remedy available to the Client under applicable mandatory law.

12. GOVERNING LAW AND JURISDICTION

12.1. These Terms and Conditions, and any dispute or claim arising out of or in connection with them, are governed by and construed in accordance with the laws of the Republic of Namibia, to the exclusion of any conflict-of-laws rules that would apply the law of another jurisdiction.

12.2. The courts of the Republic of Namibia have exclusive jurisdiction to adjudicate any dispute, claim, or matter arising from or relating to these Terms or any Booking. The Client irrevocably submits to the jurisdiction of such courts.

12.3. The Client chooses as their domicilium citandi et executandi the address provided in the Booking, or such other address as the Client may notify Envision Africa Travel of in writing, for purposes of formal notices and legal process.

13. GENERAL

13.1. These Terms, together with the applicable Booking Confirmation and any Supplier terms incorporated by reference, constitute the entire agreement between the Client and Envision Africa Travel. No prior representation, warranty, or undertaking not recorded in the Booking Confirmation is binding.

13.2. Envision Africa Travel reserves the right to amend these Terms from time to time. The version in force at the time the Booking Confirmation is issued applies to that Booking.

13.3. Any failure or delay by Envision Africa Travel to enforce a right under these Terms does not constitute a waiver of that right. No waiver is effective unless in writing and signed by an authorised representative of Envision Africa Travel.

13.4. If any provision of these Terms is held invalid or unenforceable, that provision is severed and the remaining provisions continue in full force and effect.

13.5. The Client may not cede, assign, or transfer any rights or obligations under these Terms without the prior written consent of Envision Africa Travel.

13.6. Provisions which by their nature are intended to survive completion of a Booking - including limitation of liability, indemnities, governing law, jurisdiction, and data protection - survive such completion.
